Family and Medical Leave Act
The FMLA applies to employers with 50 or more employees. It can be a very complicated and convoluted law for employers to navigate, in terms of which employees are eligible, the employer’s and employee’s notice obligations, the length of leave entitlement, intermittent leave issues, and the interaction of the FMLA with other laws, such as the ADA or state FMLA laws.
I regularly counsel employers on the FMLA, including reviewing and updating FMLA policies, ensuring that that employer is using current and appropriate forms, discussing specific leave situations and return to work issues. Of all the employment laws regarding which I counsel employers, the FMLA is the law we discuss most often.
I also represent employers who are sued for FMLA interference and/or retaliation.
